CONSTITUENCY AIDS CONTROL COMMITTEE (CACC)

What is CACC?

CACC is the local level structure mandated with coordinating the fight against HIV/AIDS at community level in line with national objectives. The establishment of the CACC was preceded by,

1) The declaration of HIV/AIDS as a national disaster in 2003,
2) The establishment of the National AIDS Control Council (NACC), and,
3) Formation of a Cabinet Sub-committee on HIV/AIDS.

The declaration of HIV/AIDS as a national disaster led to promotion of a sector- wide approach (involving diverse agencies/institutions at different levels) in fighting and managing HIV/AIDS. Subsequently, emphasis has been placed on advocacy and community involvement. Leaders, such as MPs and councillors, are expected to be actively involved in national efforts to control the rate of llIV infection and manage cases and effects of AIDS.
MACC is the national institution responsible for coordinating a comprehensive national sector wide approach at all levels to tackle HTV/AIDS. The main mandate of NACC is to mobilize resources for this fight, to co-ordinate and monitor activities of the various agencies involved in combating I IIV/AIDS and its effects, and to build the capacity of these agencies for better performance. NACC works through the CACCs at the constituency level.
CACC controls a fund at the constituency level which is used in the anti-HIV/ AIDS effort. CACCs are mainly responsible for,

(i) Receiving proposals from local CBOs, FBOs and NGOs,
(ii) Assessing/reviewing the proposals,
(iii) Approving suitable proposals for funding, and
(iv) Disbursing funds.
(v) Monitor the use of resources by community groups;
(vi) Supervise implementation of activities;
(vii) Help set up stakeholder networks for more coordinated response;
(viii) Conduct community mobilization; and
(ix) Disseminate relevant policy guidelines on control of HIV/AIDS.

CACC membership

CACC comprises representatives of civil society, key government departments at the divisional level, and representatives from the private sector. The Chairman of the Committee is elected by members during the first sitting. Divisional representatives on the Committee include District Officers, the Public Health Officer, the Community Development Assistant, Divisional Heads of Departments of the Ministries of Education and Culture and Home Affairs (Children’s office). Three members serve as women’s representatives and another three as youth representatives. The Kenya National Union of Teachers [KNU1I is represented by one member. Others are: one representative from the Faith Based Organizations, one civil society representative and one person living with
HIV/AIDS.
 

The minimum criterion for membership on CACC is an appropriate level of education for bask literacy and commitment to HR//AIDS management work. All members must demonstrate objectivity, community leadership ability and willingness to volunteer their time. They are not paid any salary but are refunded travel and subsistence costs.

The CACC forms a Technical Sub-committee of about 5 of its members whose main responsibthtv is to review and approve proposals and provide support to the implementing agencies. Only the Chairperson can sit in more than one subcommittee. Each Committee’s tenure is 2 years. The local MP acts as the patron of the CACC while an Oversight Board (see below) oversees the formation and work of the CACC.

Each constituency has a secretariat comprised of a Coordinator, an Accounts Assistant, a Statistical Clerk/Records Clerk, Typist and support staff. The employment and payment of salaries of CACC staff is the responsibility of NACC. The coordinator, who is the secretary to the committee, is also a signatory to the committee’s account. Funds are disbursed on a quarterly basis.

The Oversight Board

An Oversight Board oversees the formation of CACC in accordance with the guidelines provided in the revised framework of the NACC. The Board comprises of the area MP, District Officer within the constituency, four officers based in the division, one from each of the Ministries of Health, Education, + Ministry responsible for Social Services. The Oversight Board must ensure that CACC is as representative as possible of the diverse sectors of society. The different sectors send representatives to the Oversight Board, which takes appropriate steps to constitute the Committee.

Constituency Account

CACCs are required to operate accounts at banks nearest to them. The signatories to a CACC account include the CACC co-ordinator (secretary), who is the holder of Authority to Incur Expenditure [ME] and whose signature is mandatory. Others are the Chairman and the Treasurer. Two signatures, the coordinator’s and either Chairman or Treasurer’s, are used to draw money from the account. NACC provides the initial funds for opening the account upon submission of the minutes of the meeting of the Committee. The minutes must be signed by the CACC Chairman and Secretary.
The role of an MP
As patron to CACC, the MP is expected to take leadership in mobilizing communities in their involvement in strategies and activities against HR//AIDS.

Development

MPs oversee the activities of the Committee and the implementation of HIV/AIDS programmes. MP5 are expected to work in a non-partisan manner to make HIV/AIDS interventions effective.

Chairperson and Treasurer

The Chairperson is to be elected at the first sitting and his/her task is to chair all committee meetings. However, a temporary Chairperson may be elected to chair meetings in the absence of the Chairperson. The Chairperson is a signatory to the Account, and must sign all minutes of meetings. The treasurer, who is also elected at the first sitting, is a signatory to the CACC Account.

Projects funded through CACC:

Project proposals to CACC are funded up to a maximum of Ksh.350, 000 per organization. The priority areas are:
i. Prevention of new infections
ii. Improvement of quality of life for the infected and affected people
iii. Mitigation (reduction) of social-economic impacts of REV/AIDS
iv. Crosscutting issues such as monitoring and evaluation, gender, and research

Although the funding comes from the National AIDS Control Council, a proposal must be submitted through CACC and approved by it. The proposal must contain an approved budget, work plan and activities of the applying organization. The organization must submit the approved budget for the first quarter disbursement and the full approved amount. Once a project has been approved for funding and the organization has signed and completed the contracts/agreements and request for disbursement, the funds are sent to the organization’s bank account via electronic transfers and a note showing the transfer is sent to the applying organization. Copies of the notes are returned to NACC immediately.

Funds are disbursed in two instalments where an instalment comprises of funds required to finance activities for 90 days. All funded organizations are expected to strictly follow their work plans, activities and budgets submitted at the start of each quarter. The organizations are expected to account for the funds advanced to them by the end of 90 days from the date they are funded. If the organization does not account for the advance within six months after receiving the funds it is categorized as a defaulter. If funds are accounted for within the stipulated period but the activities do not reflect the agreed work plan, the organization could be categorized as a non-performer.

In the event of default or non-performance, the organization will face the following sanctions/penalties:
 

1. Any funding is suspended immediately or discontinued
2. The organization’s name, officials, amounts advanced and upper formed activities are made public in a manner decided by the NACC for the intended beneficiaries’ knowledge and the organization is immediately blacklisted
3. The organization and its officials are reported to law enforcement officers/organs to assist NACC recover the advanced funds using legal means
4. NACC may also request, on this basis, the relevant authorities to deregister the organization in question
5. Further, NACC reserves the right to sue the organization and officials jointly to recover advanced funds
Project proposals to the NACC are funded at constituency and national levels only.

Therefore the applicable funding limits are:
• Constituency level approval (up to Ksh. 350,000)
• National level approval (from Ksh. 350,001 - 7,500,000)
• Requests for amounts above Kshs. 7.5 million are approved by NACC upon consultation with funding partners

Submitting Proposals:
Calls for proposals are advertised in the daily newspapers and through radio announcements. The calls specify areas eligible for funding. Organizations submit proposals through the CACC for review and consideration for funding. The call for proposals is done twice a year. Organizations can seek information on calls for proposals from CACC members or office.

NACC Proposal development guidelines

A good proposal must have an Executive Summary which gives an overview of the problem, methods, activities and the expected outcomes of the proposed action. The executive summary should not be more than half a page.
Overall, the proposal should have the following:

A cover page that shows:
• Title of proposal
• Duration of the project in months
• Name of the organization
• Physical address, telephone and e-mail
• Contact person
• Location of the prolect (Sub-Location, Constituency, District and Province)
• Amount requested in shillings
• Level of support (Constituency, or National)
• Priority area coveted by the proposal

The main proposal

1. Introduction
This section gives information on the organization developing the proposal. This includes when the organization was registered, type of registration (CBO, P80, NGO etc), its mandate, relevant previous and current activities and the proposing organization’s partners, networks and collaborators.
2. Background
This section provides a statement of the problem, current situation and }justification for the action being proposed.
3 Objectives
This section provides 2-3 specific objectives of the proposal. These objectives should be specific, measurable, attainable, realistic and time-bound.
4. Methodology
This section describes the geographical area, target population including the numbers, procedures/strategies of implementation and data management (where applicable).

S. Work Plan and Budget

This section summarizes the proposal in a matrix (table) indicating each of the
2-3 main objectives, main activities, timelines, responsible persons and estimated
costs as shown below:


 

6. Monitoring and Evaluation

This section addresses what indicators the implementing agency will use to confirm progress, and how these indicators will be followed up to ensure that any changes that may be necessary in strategy are put in place. The section should also clearly state the responsibilities for reporting to NACC, including how regular monitoring and evaluation reports will be prepared and submitted.

7. institutional Capacity

This section describes the organizational management capacity, human resource capacity, organizational structure, financial management as well as the proposing organization’s partners and collaborators.

8. Accountability Capacity’

This section describes the organization’s financial management system, including banking details in place.

9. Sustainability

This section addresses how activities are able to continue after the financing is over.

10. Potential Impact/Expected Results/Output

This section describes a maximum of 2-3 potential output/outcomes expected stating the targets of the expected result/output.

Summary

Through the CACCs, the government sees an opportunity to strengthen community efforts to face the challenges of l-lIV/AIDS by raising awareness, promoting behaviour change, and involving all sectors of the society in the fight against HIV/AIDS, in a more inclusive and open manner. The challenges so far observed include the following:

(i) While MPs are expected to play an objective oversight role and mobilize communities to participate in HIV/AIDS management, reports on implementation show that some interfere with the composition of committees and influence approval of proposals from specific groups

(ii) A number of CACC coordinators double up as proposal writers for a fee, which amounts to a conflict of interest when they are the same ones who give technical advice to CACC

(iii) Most of the funded CBOs lack the necessary institutional capacity to implement projects. This has opened room for corrupt officials of NACC to exploit groups and receive payments from the fund as “facilitation”, “accounting”, and “report writing fees”!

(iv) Various groups are falling victim to recycled proposals, which they end up paying for exorbitantly

(v) Public monitoring and evaluation of funded CBOs is still difficult since the operations of the beneficiary groups are shrouded in mystery

(vi) Lack of guidance to communities has resulted in most organizations concentrating on prevention, advocacy and awareness raising and

leaving out other priority areas such as providing community care and support
(vii) The constituency level limit of Kshs. 350,000 is too low to undertake a serious project that will make an impact

(viii) REV/AIDS funding is dependent on donors as Kenya has never factored these expenditures in the national budget

The role of citizens

It is the duty of all citizens to ensure that CACC and NACC carry out their work well. Every one of us must take personal responsibility towards ensuring that Kenya contains the threat posed by HIV/AIDS. Some of the key responsibilities that citizens must take up are:
• Recognize and accept that REV/AIDS is a real and serious threat to individuals and communities

• Recognize that each one of us has a personal role to play in managing/ preventing REV/AIDS

• Sensitize the community on the existence of the NACC grants and the CACC, and their mandates

• Participate in and monitor the election of CACC representatives

• Monitor the activities of CACC to ensure fairness in the award of funds

• Monitor the activities of local organizations awarded hinds to implement REV/AIDS activities to promote accountability

• Petition the MP and NACC headquarters (write to the Director, on Box 61307-00200 Nairobi) on any irregularity noted in the election of representatives, proposal approval process or implementation of activities by funded organizations

• Participate in public activities of CACC on RIV/AIDS
